Couple blames Little General Stores for husband’s ice-related injuries

BECKLEY – A Summersville man says Little General Stores’ alleged failure to remove ice around their gas pumps caused him to suffer injuries during a fall.

Cecil and Brittany Butcher filed a lawsuit Nov. 30 in Raleigh Circuit Court against Little General Stores Inc. and its president, Greg Darby, alleging negligence and premises liability.

According to the complaint, Cecil Butcher slipped on ice he could not see around the store’s gas pumps when he visited the store to fill up his car’s gas tank on Dec. 11, 2013. The suit says he suffered physical and emotional injury, pain and suffering, and loss of consortium with his wife and newborn child. Brittany Butcher claims she suffered loss of consortium with her husband, as well as emotional and physical illness.

The Butchers seek punitive and compensatory damages to be proven at a jury trial. They are represented by Henry E. Wood III of the Wood Law Office in Charleston and William A. McCourt Jr. of Losch & McCourt in Summerville. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
