RIPLEY – A father is suing four individuals he claims gave his minor child alcohol and she was sexually assaulted afterward.
Kyle Dean Cooper, Karry Hoschar, Angela DePasquale and Thomas DePasquale were all named as defendants in the suit.
D.D., father and guardian of W.D. claims on Nov. 1, 2013, Cooper purchased intoxicating beverages for the use of and on behalf of a young man believed to be underage who was taking the beverages to a party taking place upon the property owned by Hoschar and believed to be rented by the DePasquales, according to a complaint filed in Jackson Circuit Court.
W.D., who was 14 years old at the time, was invited and attended the party with another young woman and, while attending the party, she was served alcoholic beverages, which she did not have any experience with nor realize the effects of and she was caused to be inebriated immediately.
D.D. claims following his daughter’s inebriation, she was taken to a tent and sexually assaulted and left without clothes on.
Once the sexual assault was complete and after a period of time had elapsed, another individual male minor advised W.D.’s friend that she might wish to check on her, according to the suit. When her friend went to check on her and found her partially naked, she assisted her in putting her clothes back on and another male from the party drive them away from the party and left them on the side of the road.
D.D. claims his daughter and her friend remained on the side of the road until they were found and taken to Jackson General Hospital at approximately 11:38 p.m. on Nov. 2, 2013.
W.D. suffered multiple physical, mental and emotional injuries and trauma as a result of what occurred at the party, according to the suit.
D.D. claims Cooper knew or should have known that it was both illegal, imprudent, negligent and reckless to supply intoxicating beverages to minors, which directly and proximately fueled or significantly caused or contributed to the abusive behavior to which W.D. was subjected.
The DePasquales and Hoschar negligently and recklessly failed to supervise and monitor and cause to stop the illegal, negligent and reckless activities occurring upon their property, according to the suit.
D.D. is seeking compensatory and punitive damages. He is being represented by Henry E. Wood III.
