WHEELING – A couple is suing FCA US LLC alleging violation of new vehicle warranty laws after they purchased a vehicle that malfunctioned quickly after purchase.
Jodi L. Johnson and Jeremiah R. Johnson filed a complaint on Dec. 3 in Ohio Circuit Court against FCA US LLC alleging violation of the new motor vehicle warranty law of West Virginia.
According to the complaint, the couple purchased a new 2015 Grand Cherokee Jeep in April which was both manufactured and under warranty by the defendant. With the vehicle, the couple was also granted a warranty which would be effective until a certain dollar amount in repairs and under a certain mileage. Beginning in August, the vehicle's check engine light came on, as well as a number of other malfunctions which resulted in the vehicle's unreliability and therefore disuse by the owners even after repairs. The plaintiff are suing the defendant for violation of the warranty, claiming their car should not have malfunctioned at the time it did.
The Johnsons are seeking compensation and rectification of all wrongs, damages and legal fees. They are represented by Christina Gill Roseman of the Roseman Law Firm PLLC in Pittsburgh. The case has been assigned to Circuit Judge David J. Sims.
