Wetzel Co. man accuses allegedly drunk driver of property destruction

WEST UNION – A Wetzel County man says a freight truck driver lost control of his vehicle, colliding with a barn and water well on his property.

Donald L. Prunty filed a lawsuit Dec. 21 in Doddridge Circuit Court against P&S Transportation LLC, alleging reckless driving, trespassing and gross negligence.

According to the complaint, on April 10, 2014, a driver working for P&S Transportation lost control of his tractor-trailer, colliding with several fences, gates and guardrails on Beverlin Fork Road. Prunty says the truck completely destroyed a barn and water well in the vehicle’s path on his property and claims the driver was intoxicated at the time.

Prunty seeks a jury trial and punitive and compensatory damages. He is being represented by Frank E. Simmerman Jr., Chad L. Taylor and Frank E. Simmerman III of the Simmerman Law Office in Clarksburg. The case has been assigned to Circuit Judge Timothy L. Sweeney.
