Couple accuse auto giant Chrysler of not honoring warranty

WHEELING – An Adena, Ohio couple say a Jeep they purchased has ongoing transmission problems that the dealer has failed to correct, despite three separate attempts.

Robert L. Kelley Jr. and Breanna Kelley filed a lawsuit Nov. 23 in Ohio Circuit Court against FCA U.S. LLC, formerly known as the Chrysler Group LLC, alleging breach of warranty and breach of contract.

According to the complaint, the Kelleys bought a 2015 Jeep Compass on March 17 for $26,869.09, including a three-year, 36,000-mile bumper-to-bumper warranty, plus a five-year, 100,000-mile power train limited warranty covering all power train components, including the engine, transmission and drive system. The vehicle was purchased from Constantine Motors, doing business as Elm Grove Chrysler Dodge Jeep Ram in Wheeling.

On July 11, after the cruise control was disengaged, the suit says the engine began revving independently and the gears would not shift. The problem has persisted despite three repair attempts at another dealership, according to the plaintiffs, including replacement of the transmission control module, installation of a temperature sensor and chassis wiring harness.

The plaintiffs seek a jury trial and a refund of the Jeep’s $26,869.09 price, plus litigation costs and other damages. They are represented by Frank X. Duff of Schrader, Byrd & Companion PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
