CHARLESTON – A woman in seeking compensation after she claims she was not protected from sexual hostility in the workplace.
April Hill filed a complaint on Dec. 17 in Kanawha Circuit Court against Employee Resource Group LLC and the WV Neighborhood Hospitality LLc, alleging violation of the West Virginia Humans Rights Act.
According to the complaint, Hill, an employee of an Applebee's restaurant in Beckley, alleges that she was put in a position of sexual hostility when a co-worker made multiple approaches, requesting sexual relations. She was also continuously approached and harassed by a customer who came regularly to the restaurant. When Hill voiced her concern in regards to the situation, she was told by her manager that the particular customer was valued and would not be asked to leave. In November 2014, the plaintiff was discharged, following the management's decision to take no action to protect Hill.
Hill is seeking compensation and restitution for all wrongs committed against her and for all legal fees. She is represented by Lia DiTrapano Fairless of the DiTrapano Law Firm LLC in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
