CHARLESTON — A woman is suing a physician and his employer, alleging that his negligence to recognize her husband's severe and unstable condition caused his death.
Robin Ragsdale filed suit on Dec. 11 in the Kanawha Circuit Court against the West Virginia University Board of Governors and Dr. James A. Lohan alleging negligence and failure to properly treat her husband, Tommy Ragsdale.
Tommy Ragsdale, was admitted to a CAMC medical facility for a routine colonoscopy in December 2013. During the procedure, Lohan performed a procedure that allegedly caused a leak in his colon.
The defendant sent the patient home, allegedly failing to realize the danger and gravity of the situation. Nine days after the procedure, the patient contracted sepsis and eventually died. The plaintiff is suing the defendant for negligence and failure to properly treat the patient.
Ragsdale is seeking compensation for all losses and damages suffered, both financial and emotional. She is represented by Lonnie C. Simmons of The Calwell Practice PLLC in Charleston. The case is being heard by Judge Louis Bloom.
