Hauling Reorganization accused of not paying OT

Overtime

CHARLESTON — A man is suing his employer alleging illegal practices that included depriving the employees of overtime pay.

Paul Denning filed a complaint on Dec. 1 in the Circuit Court of Kanawha County against Hauling Reorganization III Inc. alleging violation of the West Virginia Human Rights Act.

Denning provided towing services for the company. His suit said that company employees were often required to work overtime, as well as on holidays. When the employees worked overtime, they should have legally been compensated for the time worked; however, the defendant allegedly failed to provide them with overtime or holiday pay. Denning alleged that the company even went so far as to fabricate false information about payment to employees. When the plaintiff began to speak out against the actions of the defendant, he alleged he was terminated from his position.

Denning is seeking compensation for all damages suffered, lost wages and legal fees. He is represented by Trent A. Redman of The Law Offices of Redman and Payne PLLC in Charleston.
