By Kyla Asbury | Jan 12, 2016

WAYNE – The parents of two children are suing Famco Inc. after they claim it is responsible for a car accident that cause injuries.

On Sept. 28, 2013, Michael Smith was driving his personal vehicle on Piedmont Road in Wayne County at approximately 5 p.m. and slowed his vehicle down for a car pulling out into his travel lane from a side street when a Famco commercial vehicle collided with the Smith vehicle, according to a complaint filed in Wayne Circuit Court.

Shaunna Smith, Anslee Smith and Peyton Smith were all passengers in the vehicle with the Famco vehicle struck it.

The collision was caused by the recklessness, carelessness and negligence of the Famco employee and Famco for entrusting the vehicle to the employee, according to the suit.

The Smiths claim the Famco employee operated the vehicle at a high, dangerous and excessive rate of speed; failed to reduce speed to avoid a collision; failed to observe due care and precaution and to maintain proper lookout for other vehicles lawfully on the road; failed to exercise reasonable care in the operation of the vehicle; operated the vehicle in an inattentive, careless and improper manner; and failed to maintain control of the vehicle.

As a result of the defendants’ negligence, the Smiths suffered serious, painful and permanent bodily injuries; great physical pain and mental anguish; severe and substantial emotional distress; loss of capacity to enjoy life; lost wages; medical treatment; medical bills; and other injuries and losses, according to the suit.

The Smiths are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Jon D. Hoover of Hoover Andrews PLLC.

The case is assigned to Circuit Judge Darrell Pratt.
