Doctor accuses Wheeling Hospital of breach of contract

WHEELING – An Ohio County doctor is suing Wheeling Hospital after he claims it breach its employment contract with him.

On Nov. 1, 2011, Dr. Victor T. Perrone and Wheeling entered into a contract whereby Wheeling employed Perrone to practice medicine and to act as the defendant’s medical director, according to a complaint filed in Ohio Circuit Court.

Perrone claims the contract provided that he would be employed in both capacities for an initial five-year term commencing on Nov. 1, 2011, and that he would receive compensation for his services as a physician in an amount specified in the contract and would further receive compensation of $150,000 per annum for his services as medical director.

On Nov. 1, 2011, Perrone commenced providing his services and fully complied with his obligations under the contract, according to the suit.

Perrone claims on July 1, 2014, Wheeling announced that effective July 7, 2014, Dr. Shawn Stern would become medical director of the hospital.

To date, Wheeling has not terminated or attempted to terminate the employment contract as it relates to Perrone’s services as medical director and, despite having fully performed all his obligations under the employment contract, the defendant has refused to pay him compensation due to him under the contract for services as medical director, according to the suit.

Perrone claims the defendant’s actions are a breach of contract and have caused him to suffer a loss of income and annoyance and inconvenience.

Perrone is seeking compensatory damages with pre-judgment interest. He is being represented by William J. Leon of William J. Leon LC.
