CHARLESTON – A Poca couple is suing Herbert J. Thomas Memorial Hospital Association after they claim it caused injuries during surgery.
Dr. Betty A. Goad was also named as a defendant in the suit.
Donna Parsons was admitted to TMH on June 26, 2013, for performance of a robotic assisted vaginal hysterectomy performed by Goal and utilizing a da Vinci robot, according to a complaint filed in Kanawha Circuit Court.
Parsons and her husband, Gary Parsons, claim TMH, acting by and through its employee, deviated from the acceptable standards of care in its failure to provide proper and safe surgical care and management of Donna Parsons’ condition.
The defendants caused Donna Parsons to experience injury to her intra-abdominal organs and/or abdominal wall resulting in development of infection and fistula and requiring protracted surgical and medical management, according to the suit.
The plaintiffs claim Goad was negligent and deviated from the acceptable standards of care expected of a reasonable, prudent Gynecologist when undertaking to treat Donna Parsons.
Because of Goad’s negligence, Donna Parsons was forced to undergo several subsequent surgical and medical procedures and treatments which she would not have been subjected to had she been properly evaluated and had the robotic-assisted laparoscopic hysterectomy been properly performed, according to the suit.
The plaintiffs are seeking compensatory and punitive damages with pre-judgment interest. They are being represented by Marvin W. Masters and Robert P. Welsh of the Masters Law Firm LC.
The case is assigned to Circuit Judge Jennifer Bailey.
