Putnam woman blames Thomas Hospital for husband’s death

CHARLESTON – A Putnam County woman is suing Thomas Memorial Hospital for her husband’s death on behalf of his estate.

Charles McNeil was a patient at Thomas Memorial Hospital from Feb. 11, 2014, through March 31, 2014, according to a complaint filed in Kanawha Circuit Court.

Tamara McNeil claims during his stay, the hospital deviated from the applicable standard of care with regard to her husband’s pressure ulcer and was negligent in the treatment and care of her husband, which, to a reasonable degree of medical probability caused a decubitus ulcer to develop on his sacrum.

The defendant was negligent in its wound tracking that deviated from the applicable standard of care with regard to Charles McNeil’s pressure sore, according to the suit.

Tamara McNeil claims as a direct and proximate result of the defendant’s negligence, Charles McNeil developed a severe sacral decubitus ulcer due to the defendant’s failure to provide adequate care.

Charles McNeil suffered physical pain, anguish, distress, suffering, mental pain, severe emotional distress, disfigurement, loss of kindly services and has incurred medical expenses, which he continued to suffer until the date of his death, according to the suit.

Tamara McNeil is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Charles M. Love IV of the Love Law Firm.

The case is assigned to Circuit Judge Joanna Tabit.
