CLARKSBURG – Two lawsuits have been filed against the United States Postal Service for injuries sustained from a car accident.
The United States and Christopher Alan Parrotta also were named as defendants in the suit.
On Dec. 18, 2013, the defendants were the owner of a postal vehicle being driven by Parrotta, who was employed as a postal worker, according to two complaints filed in the U.S. District Court for the Northern District of West Virginia.
Dewey Lewis Tarley was a restrained driver of a 2000 Jeep Cherokee traveling east on Kingmont Road in Marion County when Parrotta negligently operated the postal service vehicle and caused a collision with the Jeep Cherokee.
Spencer Cole Tarley was a restrained passenger in Dewey Tarley’s vehicle.
Dewey Tarley sustained pain, suffering, anguish, annoyance and inconvenience; doctor, hospital and medical bills in excess of $3,306.20; the loss of ability to enjoy life and continue his normal pursuits; and property damage to the Jeep Cherokee in the amount of $5,685.
Spencer Tarley sustained pain, suffering, annoyance and inconvenience; doctor, hospital and medical bills in excess of $1,787.50; and loss of the ability to enjoy life and continue his normal pursuits.
Phillis Tarley, as administratrix of the Estate of Dewey Lewis Tarley; and Spencer Tarley are seeking compensatory damages in the amount of $20,685.20 and pre- and post-judgment interest. They are being represented by Forrest A. Bowen of Higinbotham & Higinbotham.
The cases are assigned to District Judge Irene M. Keeley.
