Insurer accuses Laurita Excavating of liability in collision case

WEST UNION – An insurance company representing Shane Transport is suing three other entities over a 2014 vehicle collision.

Selective Insurance Company of America (as subrogee of Shane Transport Inc.) filed a lawsuit on Jan. 22 in Doddridge Circuit Court against Double R Traffic Control LLC, T.K. Stanley Inc. and Laurita Excavating Inc., alleging property damage liability.

According to the complaint, a 2013 Peterbilt vehicle owned by Shane Transport collided with a truck owned by Laurita Excavating on Jan. 24, 2014, damaging Shane Transport’s vehicle. Selective Insurance blames the accident on negligent, careless driving by the operator of Laurita’s truck, as well as on traffic directions given by Double R and T.K. Stanley, which allegedly guided both vehicles to the same narrow space in the road.

Selective seeks damages of $26,753, plus legal costs and interest. It is represented by attorney Ryan S. Marsteller of Bailes, Craig & Yon PLLC in Huntington. Circuit Judge Timothy Sweeney has been assigned to the case.
