Terminated employee brings age discrimination case against Assured Partners

CHARLESTON – A Kanawha County woman says she was unlawfully fired after Assured Partners acquired her employer, Commercial Insurance Services.

Virginia Donna S. Mullins filed a lawsuit on Jan. 21 in Kanawha Circuit Court against Commercial Insurance Services; Raye King White, its president and chief operating officer; Human Resources Director Ashley K. Burton; and Assured Partners of West Virginia LLC, alleging age discrimination, violation of the Wage and Payment Act, intentional infliction of emotional distress, and violation of public policy.

According to the complaint, after working for nearly 20 years with good reviews from Commercial, Mullins was suddenly given a warning letter in 2013, and transferred to work with less bonuses and overtime pay. When Assured Partners acquired Commercial, the suit says White fired Mullins, replacing her with someone 35 years younger. The plaintiff was over 60 at the time of her termination.

Mullins seeks punitive and compensatory damages, including front pay and back pay, interest, and legal fees. She is represented by Huntington attorneys Abraham J. Saad of Saad Dixon Law Offices PLLC and John Proctor of Proctor Law Offices. Circuit Judge Joanna Tabit has been assigned to the case.
