WAYNE – A woman is using Nytis Exploration Co. after she claims it violated West Virginia code by refusing to cancel agreements it allegedly fraudulently coerced her to enter into.
On March 21, 2014, the defendant engaged in negotiations with Donna Jean Haynie and entered into lease agreements for the right to extract minerals from properties in which she owns an interest in Wayne County, according to a complaint filed in Wayne Circuit Court.
Haynie claims the defendant entered into at least three such interests, involving tracts in at least Stonewall District and Union District in Wayne County and the agreements were executed on March 21, 2014.
The agreements were obtained by the defendant through its agents and representatives from Haynie by deception, fraud and means which constituted unconscionable conduct, which entitles Haynie to a determination that the agreements should be declared null and void.
Haynie claims the defendant tendered consideration unto her in the amount of approximately $3,000 on or about March 21, 2014, and, after reviewing the process and content of the negotiations and the lease agreement and after obtaining assistance of others to evaluate representations made by the defendant’s representatives, Haynie sought to cancel the agreements and obtained an agreement from the defendant’s representatives that it would do so.
However, the defendant returned checks to Haynie and refused to honor its agreement to cancel the leases, according to the suit.
Haynie claims the defendant violated West Virginia code.
Haynie is seeking compensatory and punitive damages. She is being represented by Paul A. Ryker.
The case is assigned to Circuit Judge James Young.
