State Farm asks to move liability case from state to federal court

CHARLESTON — State Farm Insurance and two other defendants in a lawsuit have petitioned to move their case from Kanawha Circuit Court to U.S. District Court for the Southern District of West Virginia at Charleston.

Becky D. Grogg initially filed suit on Dec. 21 in Kanawha Circuit Court against State Farm Mutual Automobile Insurance Co., Camille Ragunath, Kelly Fedele and Anna Walters. The new request claims the defendants filed the motion to move the case to federal court because the sum in question exceeds $75,000 and the parties involved are from different states.

In the original complant, Grogg is seeking $100,000 of underinsured motorist coverage from a policy issued to Ted C. Wolfe, who did not purchase such coverage. Grogg is also seeking damages, the suit says, for breach of contract against State Farm, as well as damages for economic loss, attorney fees and consequential damages, plus punitive damages for alleged violations of the West Virginia Unfair Trade Practices Act.
