Property owners accuse Chase of interfering with property sale

KEYSER – A Fort Ashby man is suing Chase Bank in a dispute surrounding the sale of property in West Virginia to a couple in Pennsylvania.

William S. Wilson and John J. and Judith A. Rosenbaum filed a lawsuit Feb. 1 in Mineral Circuit Court against Chase Bank N.A., alleging unreasonable interference with a business transaction. 

According to the complaint, Wilson bought land from Rosenbaum on Nov. 29, 2009, with the understanding that a 0.5-acre parcel was to remain under ownership by Rosenbaum. However, the suit says that by mistake, the deed gave the entire property to Wilson. On Aug. 20, 2012, the plaintiffs filed a corrected deed, giving Rosenbaum the tract he originally retained. Rosenbaum claims that when he tried to sell the half-acre parcel, Chase Bank, the holder of Wilson’s mortgage, refused to recognize Rosenbaum was the rightful owner.

The plaintiffs seek a court order directing Chase to release the lien on the property, as well as $50,000 in punitive damages. They are represented by attorney Seth B. D’Atri of Trozzo, Lowery & Weston LLC in Cumberland, Maryland.
