Tri-County Tool Rentals accuses customer of not paying money owed

MOORFIELD – A Hardy County company is suing Timberoof Post and Beam over an allegedly delinquent credit account.

Tri-County Tool Rentals Inc. filed a lawsuit Feb. 1 in Hardy Circuit Court against Timberoof Post and Beam Inc., alleging breach of a credit agreement.

According to the complaint, Timberoof’s principal officer, Douglas Miller, set up credit account with Tri-County Tool Rentals with monthly payments, but has not made payments on the account. As of May 29, 2014, the suit claims $13,258.43 is still owed. The plaintiff claims Timberoof was terminated on Jan. 31, 2015, leaving Miller still responsible for the charges as the company’s remaining principal officer.

Tri-County Tool Rental seeks recovery of the entire unpaid balance of $13,258.43, plus legal interest and court costs. It is represented by attorney William H. Bean of Bean & Bean in Moorefield. Judge H. Charles Carl III is assigned to the case.
