Walmart shopper alleges store, two suppliers negligent in slip-and-fall accident

CHARLESTON – A Kanawha County man is suing Walmart, PepsiCo and Frito-Lay after an in-store display of chips and salsa allegedly collapsed, causing him to slip and become injured on the spilled product.

Arthur Buckalew filed a lawsuit Jan. 28 in Kanawha Circuit Court against Walmart Stores East L.P., PepsiCo Inc. and Frito-Lay Inc., alleging negligence.

According to the complaint, Buckalew was in the Walmart store at 2700 Mountaineer Blvd. in South Charleston on Feb. 2, 2014, when a display of salsa jars and corn chips allegedly fell in the aisle, causing him to slip and fall on the resulting debris.

Buckalew seeks a jury trial and compensation for his injuries, medical costs, pain and suffering, lost wages and lost enjoyment of life in an amount to be proven at trial. He is represented by attorney Clayton G. Anderson of The Masters Law Firm in Charleston. Judge Jennifer F. Bailey is assigned to the case.
