Apartment developers accused of poor construction for preventing flooding

CHARLESTON – A Kanawha County man is suing the owners and developers of an apartment complex, Eagle View Properties, for negligence in preventing flood damage to surrounding homes.

Steve Lupson filed a lawsuit Jan. 6 in Kanawha Circuit Court against Rabel Development LLC, Eagle View Properties LLC, EAB Global Enterprises LLC, Capitol Land LLC, Allen Bell Properties LLC, Allen Bell Properties 2 LLC and Edward Allen Bell, individually.

According to the complaint, Lupson’s real and personal property was damaged in a flood at his home, allegedly due to the defendants’ negligence in construction and management of storm water flow around the property. Lupson’s suit says the defendants’ ignored state regulations concerning water runoff and developed property on land where it could potentially cause flooding to nearby houses.

Lupson seeks a jury trial and and punitive and compensatory damages in an amount to be proven at trial. He is represented by Charleston attorneys Stuart Calwell, John H. Skaggs and Alex McLaughlin of The Calwell Practice PLLC in Charleston and by G. Patrick Jacobs of The Law Office of G. Patrick Jacobs L.C in Charleston. Judge Louis H. “Duke” Bloom is assigned to the case.
