Duncan Land & Energy accuses Tenaska Resources of contract breach

KINGWOOD — A Pittsburgh company is suing two other firms in a dispute surrounding oil and gas lease royalties.

Duncan Land & Energy Inc. filed a lawsuit Feb. 9 in Preston Circuit Court against Tenaska Resources LLC and TSAR-WV LLC, alleging breach of contract.

According to the complaint, in 2007 and 2008 the plaintiff leased 14 properties from various landowners in Preston County. The suit says those leases entitled the owners to one-eighth of the net wellhead price realized from the sale of oil or gas derived from the wells, with Duncan taking a share, as well. However, the plaintiff claims Tenaska and TSAR have failed to pay Duncan the royalty amount they are legally due.

Duncan Land & Energy seek a jury trial and damages in an amount to be determined at trial. It is represented by attorney Samuel H. Simon of Houston Harbaugh P.C. in Pittsburgh.

Judge Lawrance S. Miller Jr. is assigned to the case.
