Restaurant landlord sues owner of gas station over alleged runoff

PRINCETON — JWK LLC is suing S&S Express Inc. over a dispute involving alleged property damage.

The case was filed Feb. 10 in Mercer Circuit Court.

According to the complaint, S&S Express operates a gas station on land adjacent to the plaintiff’s property in Bluefield. On an unknown date in 2015, the suit says S&S removed underground tanks and resurfaced the surrounding pavement at the service station. JWK claims its nearby property, where restaurant Dick’s Swiss Burger operates, suffered damage due to water and debris running off S&S Express’s property.

JWK seeks a jury trial and compensatory damages, as well as an order for S&S Express to remediate the water runoff. It is represented by attorney Lawrence E. Morhous of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield.

Judge William J. Sadler has been assigned to the case.
