Wrongful death suit blames freight truck driver for husband’s fatal wreck

MOUNDSVILLE – A Marshall County woman is suing the owners and operators of a freight truck that allegedly caused her husband’s fatal car wreck.

Terry Scott, administrator of the estate of Gary Scott, filed a lawsuit Feb. 10 in Marshall Circuit Court against Denver Gibson, Glenell Gibson, Hot Rod’s Trucking LLC, Richard Gessel Trucking Inc. and The Superior Tank & Trailer Co. Inc., alleging recklessness, negligence and vicarious liability.

According to the complaint, as Gary Scott traveled north on Route 2 in Marshall County on Feb. 17, 2015, a Freightliner truck operated by Denver Gibson clipped the tail end of Gary Scott’s Chevrolet Aveo. The impact allegedly sent Gary Scott’s car spinning into the southbound lane, where it was struck by another vehicle. Although Gary Scott initially survived the accident, he died hours later on Feb. 18, 2015, at the Ohio Valley Medical Center, the suit states.

Terry Scott seeks compensation for her husband’s wrongful death, as well as medical bills, funeral expenses, lost wages and mental anguish. She is represented by attorneys Robert P. Fitzsimmons and Clayton J. Fitzsimmons of Fitzsimmons Law Firm PLLC in Wheeling.

Judge David W. Hummel Jr. has been assigned to the case.
