HUNTINGTON — Amtrak is petitioning to move a personal injury case in which it is a defendant from Cabell Circuit Court to federal court.
The motion was filed Feb. 16 in U.S. District Court for the Southern District of West Virginia Huntington Division.
According to the original complaint, Caitlin G. Sloan filed a negligence suit over personal injury liability against The Collis P. Huntington Railroad Historical Society Inc., National Railroad Passenger Corp. (doing business as AMTRAK), CSX Corp., CSX Transportation Inc. and an unnamed defendant.
Sloan’s Jan. 21 lawsuit alleges she was injured aboard an Amtrak train when she was “thrown about the train” when the engine coupled with the passenger cars.
Amtrak seeks removal of the case to federal court because the rail service was created by the U.S. Congress and a majority of the stock is government owned, qualifying it for federal jurisdiction.
