Customer accuses Appalachian Power of fraud

HUNTINGTON — A Cabell County woman is suing her electric provider, claiming the company charged her for an amount she did not owe.

Ashely Nicole Tinker filed a lawsuit Jan. 26 in Cabell Circuit Court against Appalachian Power Co., alleging fraud.

According to the complaint, when Tinker tried to open a new account with the defendant, the company told her she owed a past due balance of $685.50 for service provided from Aug. 3, 2012, through March 13, 2013. However, the plaintiff claims she never authorized this other account in her name and had no knowledge of it. Because Appalachian Power required her to pay $350 toward the outstanding balance in order to initiate service at her current address, Tinker claims the money was obtained under false pretenses.

Tinker seeks a jury trial and damages in an amount to be determined at trial. She is represented by attorney J. William St. Clair, a Legal Aid attorney in Huntington.
