CLARKSBURG — A Birmingham, Ala.-based trucking business has filed a petition to remove a property damage case in which it is a defendant from Doddridge Circuit Court to federal court.
The motion was filed Feb. 10 in U.S. District Court for the Northern District of West Virginia at Clarksburg.
In the original complaint, Donald L. Prunty accused a driver working for P&S Transportation LLC of reckless driving and property damage when his vehicle allegedly pinballed down a rural road, colliding with a barn and water well on Prunty’s farm. The suit says the driver was allegedly drunk at the time of the wreck.
P&S Transportation says the case falls under federal jurisdiction because the amount of damages is expected to top $75,000 and because the parties are in different states. It is represented by attorneys Brent K. Kesner and Shawn C. Gillispie of the Charleston firm Kesner & Kesner PLLC.
