WHEELING – A business owner incarcerated at the Morgantown federal prison is suing West Rentals Inc. in a dispute involving unpaid rent for a storage unit.

Mark C. Busack and his business, Major Savings Inc., filed a lawsuit on Feb. 11 in Ohio Circuit Court against West Rentals.

According to the complaint, West Rentals evicted Busack after he failed to pay rent for November and December 2015. Busack says he and his power of attorney were denied access to the property in storage, including perishable food items and keys to a car wash he owns. The suit says the food spoiled in storage and that Busack lost income from not having keys to his car wash business.

The plaintiff seeks damages of $29,000, return of all property he had in storage and $250 per day of lost car wash business, as well as litigation costs. Busack is representing himself. Judge David J. Sims has been assigned to the case.
