Mechanic accuses car dealership of age discrimination

HUNTINGTON — An Ohio man says his former employer, Auto Mall of Huntington, unlawfully terminated him because of his age and health conditions.

Tim Farley filed a lawsuit Feb. 16 in Cabell Circuit Court against Moses Inc., doing business as Auto Mall of Huntington, alleging age discrimination and disparate treatment under the state’s Human Rights Act.

According to the complaint, Farley worked as a collision repair specialist for Auto Mall of Huntington beginning in August 2012, and was routinely referred to by co-workers as “old man” and “pops.” Farley, who is over age 40, claims the defendant terminated him as a result of his age and health conditions, replacing him and other older co-workers with younger individuals.

Farley seeks a jury trial and damages in an amount to be determined at trial. He is represented by attorney Lia DiTrapano Fairless of The DiTripano Law Firm P.C. in Charleston.

Judge F. Jane Hustead is assigned to the case.
