Couple accuse debt collector of harassment

BECKLEY — A West Virginia couple have accused a Charleston creditor of harassing them over an alleged debt.

David F. and Stephanie M. Adkins filed a lawsuit Feb. 18 in Raleigh Circuit Court against Regional Acceptance Corp., alleging violations of the state’s Consumer Credit and Protection Act and the Computer Crime and Abuse Act.

According to the complaint, Regional Acceptance Corp. made numerous harassing telephone calls to the plaintiffs at odd or unusual hours and engaged in fraudulent, deceptive means to collect a debt — all allegedly in violation of the above-mentioned statutes. As a result of these actions, the Adkinses claim they were annoyed, harassed and caused distress.

The Adkinses seek compensatory and punitive damages, plus litigation costs. They are represented by attorneys Ralph C. Young, Christopher B. Frost, Steven R. Broadwater Jr. and Jed R. Nolan of Hamilton, Burgess, Young & Pollard PLLC in Fayetteville.

Judge John A. Hutchison is assigned to the case.
