Hotel wants to move personal injury case to federal court

CHARLESTON – A Charleston hotel originally sued in Kanawha County Court over a personal injury case is petitioning to move the suit to federal court.

Silver Creek Charleston LLC filed the notice of removal Feb. 19 in U.S. District Court for the Southern District of West Virginia, citing diversity of citizenship among the parties, as well as damages in excess of $75,000 as grounds for federal jurisdiction.

In their original complaint filed Jan. 15, Anthony and Tiffany Lewis of Pittsburgh accused Silver Creek Charleston and an unnamed defendant of causing injuries to Anthony Lewis’s head, spine, shoulder, hip and other areas. Lewis claims the injuries cost him great sums for ongoing medical care and emotional distress. Tiffany Lewis claims loss of consortium and financial damage resulting from her husband’s injuries.

The Lewises seek a jury trial and damages to be determined at trial. They are represented by attorney Vincent S. Gurrera of Gurrera Law Office PLLC in Weirton.
