WHEELING – A West Virginia man says land he purchased in 2013 contains a flaw undisclosed at the time of sale that substantially reduces its resale value.
Mark C. Busack filed a lawsuit Jan. 29 in Ohio Circuit Court against West Rentals Inc., alleging fraud.
According to the complaint, Busack purchased two parcels of land in Wheeling for $680,000 with a monthly payment of $4,062. The suit claims that the seller, James B. Thomas, property manager of West Rentals, failed to disclose the existence of a ground slip at the rear of the property at 375 Oglebay Drive. Busack claims financial damage because the flaw will require remediation, and could render the land impossible to sell.
Busack seeks a jury trial and damages of $131,300, plus litigation costs and interest. He is representing himself. Judge David J. Sims is assigned to the case.
