Daughter blames nursing home for mother’s injury, death

WHEELING — An Ohio County woman is suing Good Shepherd nursing home, claiming negligence by staff led to her mother’s death.

Ann Morgan, administrator of the estate of Katherine Aileen Sprowls Beery, filed a lawsuit Feb. 24 in Ohio Circuit Court against Good Shepherd Nursing Home L.C., alleging negligence and medical malpractice.

According to the complaint, Beery was a resident of Good Shepherd with instructions that she have a three-person assist from a potty chair to her bed. When only two employees assisted in a transfer on Feb. 16, 2015, the suit says, Beery suffered a fractured right femur. After surgery to repair the leg fracture, Beery remained hospitalized until her death on Feb. 20, 2015.

Morgan seeks a jury trial and punitive and compensatory damages in an amount to be determined at trial. She is represented by attorney Robert P. Fitzsimmons of the Fitzsimmons Law Firm PLLC in Wheeling.

Judge David J. Sims is assigned to the case.
