Homeowners claim mortgage fraud in suit against Selene Financial

PRINCETON — A Mercer County couple is suing their mortgage lender in a dispute surrounding an alleged scam to foreclose on their home.

Dillard Lyle Jr. and Schvonne Lyle filed a lawsuit on Feb. 25 in Mercer Circuit Court against Selene Finance L.P., alleging breach of contract.

According to the complaint, the Lyles fell behind on their mortgage beginning in the spring of 2014 after the adoption of their daughter and a period of unemployment. Although the Lyles contracted with Selene Finance in a program to prevent foreclosure, the suit says Selene is trying to violate the agreement by failing to provide required notices and prior to accelerating the loan in order to foreclose.

The Lyles seek a jury trial and damages to be determined at trial, plus litigation costs. They are represented by attorney Sarah K. Brown, Bren J. Pomponio and Daniel F. Hedges of Mountain State Justice Inc. in Charleston.
