CHARLESTON — A West Virginia woman says the apartment complex where she lived for two years is trying to collect rent she doesn’t owe.
Heather Blankenship filed a lawsuit Feb. 10 in Kanawha Circuit Court against Southmoor Hills Apartments LP and Healthcare Financial Services LLC, alleging violations of the West Virginia Consumer Credit and Protection Act.
According to the complaint, once Blankenship’s one-year lease at Southmoor ended, she began renting a unit month-to-month. The suit says she gave the defendant 30 days’ notice, leaving the complex in February 2015.
Almost a year later, Blankenship says, she received a bill from Southmoor for $5,687, or the equivalent of nine months’ rent. Southmoor allegedly claims Blankenship did not give proper notice of her intent to move out.
Blankenship seeks a jury trial and general and punitive damages, plus litigation costs. She is represented by attorneys Benjamin Sheridan and Mitchell Lee Klein of Klein & Sheridan LC in Hurricane.
Judge Charles E. King has been assigned to the case.
