Landlord accuses former tenant of owing unpaid rent

NEW CUMBERLAND — A Hancock County firm is suing a tenant in a dispute surrounding a property lease.

Tony P. Sellitti Construction Company Inc. filed a lawsuit March 2 in Hancock Circuit Court against Joseph Farran, doing business as 1 LV Yogurt, alleging breach of a lease agreement.

According to the complaint, the parties signed a three-year lease for a property on Penco Road in Weirton on Jan. 6, 2014. The suit says Farran vacated the store’s premises on May 1, 2015, leaving a remaining balance owed on the lease of $14,850 through Jan.1, 2016; Sellitti Construction also states that an additional $23,100 is due for the remaining months of the three-year lease term through March 31, 2017.

The plaintiff seeks a jury trial and recovery of the entire rent amount due of $37,950, plus litigation costs. It is represented by attorney James J. Sellitti of Sellitti, Nogay & McCune PLLC in Weirton.

Judge David J. Sims is assigned to the case.
