Landowner accuses Markwest of failing to pay for pipeline easements

WEST UNION — A Doddridge County man is suing a Colorado firm in a dispute over easements for oil and gas pipelines.

Dennis F. Foreman filed a lawsuit March 2 in Doddridge Circuit Court against Markwest Liberty Midstream & Resources LLC, alleging breach of contract, fraud and willful trespass.

According to the complaint, the parties entered a right-of-way agreement on Jan. 18, 2012 whereby Markwest was to pay Foreman $12,300 for the right of way, $28,700 for the first pipeline, $24,600 for each of three additional pipelines, and timber damages of $8,200. So far, the suit says he has received only $20,500 under the agreement, but has not been paid for the four pipelines installed on his property.

Foreman seeks $102,500, the amount he is allegedly due under the contract. He is represented by Clarksburg attorney Stephen A. Wickland.
