Homeowner blocks CitiFinancial’s foreclosure bid

Stop foreclosure

BECKLEY – A Mineral County man is suing his mortgage lender to stop a foreclosure on his home.

Dana L. Stouffer filed a lawsuit March 4 in Mineral Circuit Court against CitiFinancial Inc., alleging abusive mortgage servicing.

According to the complaint, income loss caused Stouffer to default on a home loan from the defendant, owing a remaining balance $56,276. With a loan modification and a new job, the suit says, he was able to resume monthly payments, but still owes the lump sum needed to bring the loan current. Stouffer claims CitiFinancial sent him a foreclosure notice on March 8, a week before the planned sale, despite his willingness to make payments.

Stouffer seeks a jury trial, cancelation of the foreclosure and a permanent, affordable loan modification. He is represented by Legal Aid attorney Erin A. Clark of Martinsburg.
