Worker’s crushed foot leads to negligence case against McElliotts Trucking

CHARLESTON – A Kentucky man is suing a West Virginia trucking firm in a dispute surrounding a workplace injury.

Richard Edwards Jr. filed a lawsuit Feb. 26 in U.S. District Court for the Southern District of West Virginia against McElliotts Trucking LLC, Cardinal Transport Inc. and Danny McGowan and Harold Midkiff, individually and as employees of the other defendants, alleging negligence.

According to the complaint, Edwards was helping McGowan load steel pipes onto a commercial truck on Oct. 3, 2015, at McElliotts’ freight yard in Kenova. As Edward was preparing to unfasten a strap used to hoist the pipes, the suit says McGowan unexpectedly placed the forklift in reverse. As a result, Edwards says some of the pipe was dragged off the truck, crushing his foot and causing amputation of leg below the knee.

Edwards seeks a jury trial, litigation costs and general and special damages to be determined at trial. He is represented by attorneys Richard W. Weston and Connor D. Robertson of Weston Law Office in Huntington.
