Worker accuses ex-employer of wrongful termination

Termination

BECKLEY — A Raleigh County man is suing his former employer, claiming he was terminated after filing for workers' compensation benefits.

Rodney Nutter filed a lawsuit Feb. 17 in Raleigh Circuit Court against Crossroads Chevrolet LLC, alleging retaliatory discharge.

According to the complaint, Nutter applied for (and received) workers' compensation after a Dec. 29, 2014 on-the-job injury. Upon being released to go back to work, the suit says, Nutter was terminated by Crossroads, allegedly for filing a workers' compensation claim.

Nutter seeks a jury trial and recovery of lost wages, benefits and litigation costs. He is represented by Fayetteville attorney Greg A. Hewitt.

Judge John A. Hutchison is assigned to the case.
