Car buyers accuse Hometown Hyundai of contract breach

Payment overdue

BECKLEY – A couple is suing a car dealer for allegedly breaking a promise to pay off they vehicle they traded toward a new one.

Stephen and Heather Vandall filed a lawsuit Feb. 17 in Raleigh Circuit Court against Hometown Hyundai, alleging breach of contract.

According to the complaint, the plaintiffs purchased a 2016 Hyundai from Hometown on Oct. 31, 2015, with the stipulation that Hometown was to pay off the remaining amount owed on the couple’s 2011 Hyundai trade-in car.

However, the suit says Hometown Hyundai failed to pay off the older car, causing the Vandalls to receive collection calls, as well as late fee charges and a negative credit report.

The Vandalls seek statutory and compensatory damages to be proven at trial. They are represented by Beckley attorney Greg A. Hewitt. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
