Injured couple blames cargo van driver for injuries

HUNTINGTON — A Wayne County couple is suing a Huntington firm for a car crash allegedly caused by one of its drivers.

Brad and Amy Browning filed a lawsuit Feb. 12 in Cabell Circuit Court against Michael Johnson, Tristate Holdings LLC and Tri-State Water Proofing LLC, alleging personal injury liability.

According to the complaint, the Brownings were struck Dec. 9, 2014 by a cargo van Johnson as he worked for Tri-State Water Proofing. The suit says Johnson was speeding and otherwise careless when he failed to stop at an intersection on Washington Avenue in Cabell County. The Brownings say they suffered serious head and body injuries, some of which are permanent, and emotional distress.

The Brownings seek a jury trial and compensatory damages to be proven at trial, plus interest and litigation costs. They are represented by attorney Neil R. Bouchillon of Bouchillon, Crossan & Colburn L.C. in Huntington.

Judge F. Jane Hustead is assigned to the case.
