BECKLEY – Lamar Texas Limited Partnership is suing Love Family Practice Group after it claims the company breached its contract.
On Nov. 19, 2014, the defendant entered into an advertising contract with Lamar wherein it agreed to purchase advertising space for the period of Nov. 24, 2014, until Nov. 22, according to a complaint filed in Raleigh Circuit Court.
Lamar claims at the defendant’s request, Lamar provided the agreed upon billboard space and advertisement with the understanding that it would be paid each month in a timely manner.
Love has not paid Lamar in full for the advertising and a total principal amount of $8,470 remains due, according to the suit.
Lamar claims Love has been unjustly enriched at its expense and, despite demands for payment, Love has failed and refused to pay.
The defendant received and accepted the benefit of advertising provided by the plaintiff and was aware that the plaintiff was providing the advertising and expected to be paid for such, according to the suit.
Lamar is seeking judgment in the amount of $8,470 with interest. It is being represented by John R. Keating of Amato Keating & Lessa.
