Injured worker accuses firm of deliberate safety violations

BECKLEY — A Fayette County man says he suffered on-the-job injuries while working for a firm in Raleigh County.

Eric Neal II filed a lawsuit March 1 in Raleigh Circuit Court against Tams Management Inc., alleging personal injury liability and deliberate intent.

According to the complaint, Neal was working for Tams Management on May 26, 2015, when he suffered a traumatic injury to his back and neck. Neal claims the defendant knew unsafe conditions existed on the worksite, and knowingly allowed work to continue, in violation of state and federal safety standards.

 

Neal seeks a jury trial and compensatory and punitive damages, plus litigation costs. He is represented by attorney Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville.

Judge H.L. Kirkpatrick III is assigned to the case.
