Storage unit company accuses renters of failing to pay lease

BECKLEY — A Tennessee firm is suing a Raleigh County business and two individuals in a dispute over rent payments for a storage unit.

Barn Lease Corporation of America Inc. filed a lawsuit March 1 in Raleigh Circuit Court against West Star Management Inc., Whittney L. Cline and Vondie Brunty, alleging breach of contract, possession of personal property and conversion.

According to the complaint, the defendants leased a 12-by-24-foot portable storage unit from Barn Lease Corp. on April 18, 2013, for a 36-month term at $227 per month. The suit says the defendants were liable under the rental agreement if the unit were lost, stolen, damaged or destroyed for its fair market value of $4,620.

Barn Lease Corp. claims the defendants have stopped paying rent for the unit, and alleges that outstanding rent in arrears as of Feb. 5 amounts to just under $3,847, and also claims that the defendants have refused to relinquish the unit.

Barn Lease Corp. seeks recovery of the unpaid rent, an order authorizing return of the unit, or in the event it is damaged, recovery of its value of $4,620. The plaintiff is represented by attorneys James W. Lane and Bradford P. Bury of Flaherty Sensabaugh Bonasso PLLC in Charleston.
