Auto buyers seek rescission of sales contract over alleged warranty breach

MOUNDSVILLE – An Ohio couple is suing Fiat Chrysler U.S., claiming they were sold a defective vehicle.

Allissa Gianangeli and Rock Gianangeli filed a lawsuit in Marshall Circuit Court against FCA US LLC, alleging violations of car warranty laws in West Virginia and Ohio.

According to the complaint, the Gianangelis purchased a new 2015 Chrysler 200 for $27,012 from a West Virginia dealership on May 20, 2015. After the purchase, the plaintiffs claim they experienced serious non-conformities with the vehicle’s warranties, including malfunctioning dash warning lights and loss of power. Despite several attempts at repairs under warranty, the suit says the vehicle is still defective, compromising its safety and value.

The Gianangelis seek a jury trial, cancellation of the sales contract, interest, and punitive and compensatory damages in an amount to be determined at trial. They are represented by attorney Christina Gill Roseman of the Roseman Law Firm PLLC in Pittsburgh. Judge David W. Hummel Jr. is assigned to the case.
