Eric S. Simpson was employed as a CAN and staff coordinator from November 2012 until November 6, according to a complaint filed in Monongalia Circuit Court.
Simpson claims he injured his back at work at Mapleshire Nursing Home on Aug. 12, 2013, and he had two surgeries at Ruby Memorial Hospital and he suffers from what is called “failed back syndrome.”
The plaintiff returned to light work duty in October 2014 and he still has an open worker’s compensation case with Brickstreet, according to the suit.
Simpson claims upon his return to work, he began experiencing a hostile work environment about his disability and also he suspected his sexual orientation because he is a gay man.
The plaintiff complained to managers that he felt he was being discriminated against because of his disability and being gay and finally, in the face of constant harassment, Simpson resigned from his employment, according to the suit.
Simpson claims the defendants discriminated against him and violated the West Virginia Human Rights Act.
Simpson is seeking compensatory and punitive damages. He is being represented by Edward R. Kohout.
