Medical practice hit with two wage payment violation lawsuits

BECKLEY – Two lawsuits have been filed against Love Family Practice Group after former employees claim it violated the West Virginia Wage Payment and Collection Act and also engaged in improper medical billing practices.

Brian S. Love M.D. Inc. is trading as Love Family Practice Group.

Amanda Duesing and Samantha Adkins were employed as licensed practical nurses with Love and during their employments, they were asked to correct charts for patients they did not treat, according to three complaints filed in Raleigh Circuit Court.

Duesing and Adkins claim when they checked with the nursing board, they were informed that this was improper and unethical, so they informed the defendants of this.

While employed by the defendant, Love also engaged in improper medical billing, according to the suits.

The plaintiffs claim in March 2014, they were constructively discharged as they were forced to quit rather than engage in unethical and possibly illegal conduct.

As a direct and proximate result in the acts of the defendant, the plaintiffs have been annoyed, aggravated, suffered lost income and were otherwise harmed, according to the suits.

The plaintiffs claim the defendant violated the West Virginia Wage Payment and Collection Act by requiring the plaintiffs to work overtime and attend mandatory meetings for which they were not paid.

The plaintiffs are seeking compensatory and punitive damages. They are being represented by Greg A. Hewitt of Hewitt & Salvatore PLLC.
