Injured guest accuses casino of hazardous conditions

NEW CUMBERLAND – A Hancock County woman is suing a casino over allegedly hazardous conditions that caused her to fall and suffer permanent injuries and lost wages.

Dorinda Kalan filed a lawsuit March 8 in Hancock Circuit Court against Mountaineer Park Inc., MTR Gaming Inc., Éclair Holdings Inc., several unnamed defendants and entities doing business as Mountaineer Casino Racetrack and Resort, alleging negligence and premises liability.

According to the complaint, Kalan was injured on the defendant’s property in Hancock County on Sept. 20, 2014. While attempting to descend a staircase connecting the raised, older gaming area to the facility’s main floor, the suit says Kalaln fell, suffering an ankle dislocation and fracture, musculoskeletal injuries, an permanently altered gait, and other physical and psychological wounds.

Kalan seeks a jury trial and compensatory damages to be proven at trial. She is represented by attorney Michael A. Adams of Hinerman & Associates in Weirton. Judge James P. Mazzone is assigned to the case.
