LOGAN – A Logan County woman who serves on active duty in the U.S. military says her bank repossessed her vehicle after she was transferred to California.
Lori Justice filed a lawsuit March 2 in Logan Circuit Court against Branch Banking & Trust Co., alleging breach of contract.
According to the complaint, after Justice defaulted on her car loan, she received threatening, abusive and rude debt collection calls from the bank. Soon after, the suit claims BB&T had the vehicle repossessed in November 2015 without giving the plaintiff an advance notice of default or right to cure. Justice says the defendant realized its mistakes and subsequently returned the vehicle on Dec. 3, 2015. She is suing for harassment, inconvenience and distress.
Justice seeks a jury trial, injunctive relief to remedy any negative credit reporting, and actual and statutory damages. She is represented by attorney Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates in Logan. Judge William Douglas Witten is assigned to the case.
